Uninsured or Under-Insured Motorists

Following a car accident, you take down the other party’s insurance information. But what if the other party has no insurance or doesn’t have adequate insurance to cover your damages and injuries? When you need an experienced attorney because you’ve been hurt by a Georgia uninsured or under-insured motorist, call Atlanta car accident attorneys Goldstein & Hayes, P.C.

The minimum insurance required by law is $25,000 per person, hardly enough to cover serious damage and especially injury. Many Georgia drivers carry only the minimum, and approximately 16% carry no insurance at all. Some people offer expired cards at the scene of an accident. Also be aware that insurance databases are not always kept up to date. A police check may show the other driver as insured, when the policy has actually lapsed. If you sustain neck and back injuries or other serious injuries, you can’t be compensated when the bills pile up, not to mention the benefits owed to Georgia drivers who have wrecked cars repaired.

Underinsured Motorists Georgia Attorneys

In 2009, GA Uninsured/Underinsured Motorist Law (O.C.G.A. 33-7-11) was amended by Senate Bill 276 to permit vehicle owners to buy additional coverage to protect against uninsured or underinsured drivers. The limits of this additional coverage “stack” on top of the other driver’s liability coverage.

You may also keep the uninsured motorist coverage in effect prior to January 1, 2009, but that coverage reduces the amount of the other driver’s liability by the amount of your coverage. The premium is lower, but the savings aren’t worth the loss of coverage. Deciding not to buy UM/UIM insurance is a risky choice, considering the number of uninsured and underinsured motorists on Georgia roads.
